By accessing or using Codinamo ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "You") and Codinamo ("We", "Us", "Company"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Codinamo is a deployment pipeline management platform that enables users to:

• Create and manage CI/CD pipelines through a visual interface
• Execute automated deployments to various environments
• Integrate with third-party services (Git providers, cloud platforms, etc.)
• Monitor and track deployment executions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must:

• Be at least 16 years of age
• Provide accurate and complete registration information
• Maintain and update your account information
• Not create an account using a false identity or misleading information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or misuse the Service
• Fail to pay applicable fees

4. Acceptable Use Policy

4.1 Permitted Use

You may use Codinamo for legitimate software deployment and CI/CD automation purposes in accordance with these Terms and applicable laws.

4.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal, harmful, or fraudulent purpose
• Deploy malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to mine cryptocurrency without explicit permission
• Overload or disrupt the Service infrastructure (DDoS, abuse, etc.)
• Scrape, crawl, or reverse engineer the Service
• Resell or redistribute the Service without authorization
• Violate intellectual property rights of Codinamo or third parties
• Use the Service to spam, phish, or distribute unsolicited communications

5. Subscription Plans and Billing

5.1 Free Plan

The Free plan includes:

• 60 build minutes per month
• Limited to 1 parallel execution
• Up to 5 team members

We reserve the right to modify Free plan limits at any time with 30 days notice.

5.2 Pro Plan

The Pro plan is billed at $0.01 per build minute:

• Pay-as-you-go pricing with no monthly minimum
• Unlimited parallel executions
• Unlimited team members
• Priority support

5.3 Enterprise Plan

Enterprise plans are subject to custom pricing and separate agreements.

5.4 Payment Terms

• Payments are processed monthly in arrears for Pro plans
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for all applicable fees
• Failure to pay may result in service suspension or termination
• We reserve the right to change pricing with 30 days notice

5.5 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

• You will continue to have access until the end of your billing period
• No refunds will be provided for unused time or build minutes
• Your account will be downgraded to the Free plan automatically

6. Intellectual Property Rights

6.1 Ownership

Codinamo retains all rights, title, and interest in:

• The Service and its underlying technology
• Trademarks, logos, and branding
• Documentation and proprietary information

6.2 Your Content

You retain all rights to your code, configurations, and data ("Your Content"). By using the Service, you grant us a limited license to:

• Store and process Your Content to provide the Service
• Perform technical operations (caching, backups, etc.)
• Use anonymized, aggregated data for analytics and improvements

We do not access, view, or use Your Content except as necessary to provide the Service or as required by law.

6.3 Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without compensation or attribution.

7. Service Level and Availability

7.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as available."

7.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily interrupts the Service. We will provide advance notice when reasonably possible.

7.3 Support

• Free plan: Community support via forums and documentation
• Pro plan: Email support with 24-hour response time
• Enterprise plan: Dedicated support with custom SLA

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

8.1 Data Backup

While we perform regular backups, you are responsible for maintaining your own backups of Your Content. We are not liable for data loss.

8.2 Data Deletion

Upon account deletion, we will delete Your Content within 30 days, except where retention is required by law or for legitimate business purposes (billing records, etc.).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of uninterrupted, error-free, or secure operation
• Accuracy, reliability, or completeness of the Service

YOU USE THE SERVICE AT YOUR OWN RISK. WE DO NOT WARRANT THAT YOUR DEPLOYMENTS WILL BE SUCCESSFUL OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CODINAMO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR DAMAGES CAUSED BY THIRD-PARTY SERVICES, YOUR MISUSE, OR FORCE MAJEURE

11. Indemnification

You agree to indemnify, defend, and hold harmless Codinamo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or deployment activities

12. Third-Party Services

The Service integrates with third-party services (GitHub, GitLab, AWS, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their availability.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of the Service.
